Welcome to Near Punks (NPunks), a historic NFT collection on the NEAR blockchain. By accessing or using our website, services, or purchasing any NPunks NFTs, you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully before using our services.
1. About Near Punks
Near Punks (NPunks) is a collection of 10,000 unique digital collectibles living on the NEAR blockchain. NPunks was the first NFT collection to complete mint on the NEAR blockchain, making NEAR history on October 11, 2021. Each NPunk is a unique digital asset with verified ownership and authenticity through blockchain technology.
2. Acceptance of Terms
By accessing our website, participating in our community, or purchasing NPunks NFTs, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
3. Eligibility
You must be at least 18 years old to use our services. By using our services, you represent and warrant that you are of legal age to form a binding contract and meet all eligibility requirements outlined in these Terms.
4. NFT Ownership and Rights
When you purchase an NPunk NFT, you own the underlying NFT completely. This includes:
- The right to sell, trade, or transfer your NPunk NFT
- Personal use rights for the associated digital artwork
- Access to exclusive holder benefits and rewards (50% revenue sharing from NPunks products)
- Participation in the OtherVerse ecosystem
However, you do not own the underlying intellectual property rights to the NPunk artwork, which remain with the Near Punks project creators.
5. Marketplace and Trading
NPunks can be traded on various NEAR blockchain marketplaces including TradePort, Paras, and MintBase. We do not control these third-party marketplaces and are not responsible for their operations, fees, or policies. All transactions are final and irreversible on the blockchain.
6. Prohibited Uses
You agree not to:
- Use NPunks for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Infringe upon or violate our intellectual property rights or the rights of others
- Harass, abuse, or harm others in our community
- Submit false or misleading information
- Use our services to transmit malware or other harmful code
7. Disclaimers
NPunks are provided "as is" without warranties of any kind. We do not guarantee the value, utility, or performance of any NPunk. The value of NFTs can be volatile and may decrease to zero. You acknowledge that purchasing NFTs involves risk and you may lose your entire investment.
8. Limitation of Liability
To the fullest extent permitted by law, Near Punks and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or goodwill, arising out of or in connection with your use of our services.

You agree to indemnify and hold harmless Near Punks and its creators from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.
